Client Terms & Conditions

1 - Definitions

1.1 - “Company” refers to WorkBalance (WB).

1.2 - “Customer” refers to the client, or company who has booked WorkBalance services.

1.3 - “Class” or “Classes” refer to The Company’s corporate wellbeing classes online or on-site.

2 - Booking & Payment terms

2.1 - Customers are required to pay for corporate bookings within 30 days of invoice receipt either on a rolling monthly basis, or for the agreed number of sessions.

2.2 - Prices are agreed prior to the first session, these may change from time to time, but all bookings made prior to change in price will remain unchanged.

3 - Cancellations 

3.1 - Classes operate a 48 hour cancellation policy. Where cancellations are made by the Customer in sufficient time, credit will be added back to the relevant account, or a paid for class will be rolled over to another week. Classes cancelled with less than 48 hours notice will still incur the full fee.

3.2 - If an Instructor cancels The Company will endeavour to find a suitable substitute. Where this is not possible for reasons outside the control of The Company, The Company will not be liable but will at its discretion issue a credit note.

4 - Locations and Start Times

4.1 - Customers and teachers are asked to arrive at least 5 minutes prior to the start of the Class. The Company reserves the right to refuse entry to anyone arriving after the start of the Class.

4.2 - For corporate and private bookings, the location must be agreed between the Company and the Customer five days prior to the first class and it is the responsibility of the Customer to ensure the location is safe and suitable for a wellbeing class. 

5 - Fitness and Health

5.1 - The Company advises Customers not to take part in one of the Classes without first seeking medical advice if they have any concerns at all over their physical condition.

5.2 - Customers with low or high blood pressure or cardiovascular irregularities should not attend the Class without express and written permission from a medical professional.

5.3 - The Company reserves the right to refuse access to any Customer if it in any way doubts the health of the Customer and their ability to safely take part in the Classes.

5.4 - Customers accept the risk of injury from performing exercises in the Classes. The Company accepts no liability for injury to the Customer, except insofar as such injury is by law incapable of exclusion.

6 - Copyright 

6.1 - Unless agreed in writing, the Customer is not allowed to photograph, copy, duplicate or video any artistic material provided to them via the Company.

6.2 - Such material, and the format  of class, will belong to the Company and be capable of being licensed by the Company alone.

6.3 - Where the Company  authorises a video of the class then it may only be used for the agreed authorised purpose and  for a period not exceeding one year from the date of instruction.

7 - Data Protection

7.1 - All personal information provided to WorkBalance will be handled with confidence. WorkBalance will strictly  follow national and EU data protection, data transfer and data retention regulations. 

7.2  - Personal information provided by clients will not be given to any unauthorised third parties unless required by law. 

7.3 - WorkBalance complies with the Data Protection Act 2018.

8 - Rights 

8.1 - WorkBalance has the right to use client testimonials on the WB website or any other WB platform, unless requested not too.

Instructor Terms & Conditions

1 - Definitions

1.1. - “Instructor” refers to the person or persons responsible for overseeing and teaching any classes booked.

1.2. - “Instructor Terms and conditions” refer to this document.

1.3. - “WB” refers to WorkBalance.

1.4. - “Customer” refers to any clients introduced to you by WorkBalance.

2 - Payment

2.1  Instructors must send their invoices to hello@work-balance.co.uk before the end of each month for all classes taught during that month.

2.2 Instructors will be paid on the last day of the month, provided an invoice has been received.

2.3 Instructors must include the ‘Customer name’, ‘date’ and ‘class’ for each class taught on their invoices.

3 - Customer <> Instructors <> WB Protocol

3.1 - Corporate and private bookings are an arrangement between the WB and the Customer. All class bookings, cancellations and arrangements are to be made between WB and the Customer (with the teacher keeping informed throughout). 

3.2 - Any customers booking or attempting to book a WorkBalance Instructor independently and not through WB will result in a termination of the instructors’s contract and any other bookings with the Company.

3.3 - Following the termination of a corporate or private contract, the former WB Instructors is not permitted to teach the Customer for 6 months after the date of the final class. If the former teacher continues to teach the Customer within the 6-month period after the final class, the Customer will be obligated to reimburse WB for the full amount paid to the teacher for these classes. 

3.4 - During any classes organised by WB, instructors are representing the brand therefore must:

3.4.1 - Not sell personal services, such as workshops, classes and retreats during any classes taught on behalf of WB.

3.4.2 - Introduce themselves as “ ‘Their name’, from/on behalf of WorkBalance”

3.4.3 - Use the WB branded slide templates provided, for their first and last slide, for any classes making use of slides.

3.5 - Instructors must arrive and be ready to teach at least 5 minutes before class start time. 

3.5.1 - If an Instructor arrives late and the Customer wants to be reimbursed, this cost will be passed on to the Instructor.

3.6 - Instructors must provide 24 hours notice for cancellation where possible and help to find a replacement when required.

4 - Insurance

4.1 - All Instructors must be insured for the classes they teach and Customers accept the risk of injury from performing exercises in the Classes. The Company accepts no liability for injury to the Customer, except insofar as such injury is by law incapable of exclusion.

5 - COVID 19 Protocol 

5.1 - Instructors must teach in accordance with COVID-19 Government Guidelines.

6 - Bookings

6.1 - When accepting a booking to provide services for us, we will confirm the details to you in writing and your acceptance to these terms forms a contractual agreement with us for the full services booked. Your acceptance shall be deemed to incorporate these terms and conditions.

7 - Data Protection

7.1 - All personal information provided to WB will be handled with confidence. WorkBalance will strictly follow national and EU data protection, data transfer and data retention regulations. 

7.2 - Personal information provided by Instructors will not be given to any unauthorised third parties unless required by law. 

7.3 - WB complies with the Data Protection Act 2018.

8 - Rights

8.1 - WB has the right to use images provided by the Instructors on the WB Website.
